A – Booking Lessons:
A1: Students can arrange a lesson by submitting a ‘request’ to the instructor. This can be via text or call. The instructor retains full discretion to either accept or decline the request.
A2: It is the responsibility of both parties to agree to the date, time, location, and duration of the lesson.
A3: While the instructor cannot guarantee regular lesson times or dates, upon accepting a booking from the student, the instructor will make reasonable efforts to provide regular lesson slots for the student’s convenience.
B – Late for a lesson:
B1: Students should contact the instructor if they know they will be late for a lesson. If the student arrives (or is not ready) 15 minutes after the scheduled start time, the lesson may be cancelled and the instructor will reserve the right to be compensated for this time.
B2: If a delay to the start is at least 15 minutes due to the instructor’s prior obligations, the instructor will notify the student. If the student wishes to cancel the lesson due to the instructor being late, the instructor will either:
- Refund the student in full, any advance payment that the student has made for that lesson,
- Reschedule the booking.
C – Cancellations:
C1: Student Cancelation
- C1 a: Students can cancel lessons if the instructor is notified at least 48hours before the lesson.
- C1 b: If a student does not give 48hours advance notice, the instructor will be entitled to charge the full price of the lesson.
C2: Instructor Cancelation
- C2 a: The Instructor may, without incurring any liability to the student, cancel a booked lesson at any time before or during the lesson.
- C2 b: If the instructor has reason to believe that the student is not fit to drive at the time of the lesson due to any factors including, but not limited to, alcohol, drugs (whether prescribed or otherwise), illness or other medical conditions, the instructor will cancel the lesson. the instructor will treat this as cancellation without notice from the student. (C1 b)
D – Fees & Payment:
D1: The student must pay the instructor’s fees for all lessons. Students can obtain information on current lesson fees from https://unlockdriving.com or from the instructor directly.
D2: Any person who becomes a student while the instructor is offering a specific hourly rate will maintain that hourly rate until they are no longer a student of Unlock Driving; this means they will not be affected by any increase in the instructor’s pricing.
D3: The student shall make payment to the instructor in advance or at the start of the lesson by cash or direct bank transfer (instructors do not accept cheques).
F – Driving Test:
F1: The instructor has full discretion for the use of their vehicle for test purposes.
F2: If a test is booked without prior consultation with the instructor and a prior agreement is reached in this regard. On the occasions that advice of the driving instructor is ignored, we cannot guarantee the use of the instructor’s car for the test.
F3: When the student attends a test, they must take all required documentation with them. If they do not, their test may be cancelled, and they will lose their test fees.
- F3 a: If the instructor’s car breaks down or is otherwise unavailable or unusable on the date of the test, the instructor shall use their reasonable endeavours to arrange an alternative vehicle. If this is not possible, the instructor shall pay for the replacement test.
- F3 b: If the student has a test booked and, in the instructor’s opinion, does not make the expected progress in their lessons between the date of booking and the test date, the instructor may decide to not permit the student to use their vehicle for that test, and the instructor will not be responsible for any fees that they pay for the test which may be lost.
G – Feedback/Complaints:
G1: the instructor always welcomes feedback from students. While the instructor always uses all reasonable endeavours to ensure that they provide a high standard of tuition and service to pupils, if students have any feedback or complaints regarding the instructor’s tuition, services, or any other matter, they are encouraged to raise the issue with the instructor either in person or by text. Student feedback is important for improving the learning experience and ensuring student satisfaction.
H – Personal Data (Data Protection):
H1: All personal information/video/audio that the instructor may use will be collected, processed, and held in accordance with the provisions of The Data Protection Act 2018. This information is collected for communication, teaching, safety and insurance purposes. All data will be retained only for as long as is necessary to provide tuition and in line with the instructor’s responsibility to maintain effective records.
- H1 a: The information collected and stored on a secure online/digital database may be all or any of the following: Name, Address, Age and Date of Birth, Phone number(s), Email address(es), Driving Licence number, Basic information about any health conditions that may affect the student’s ability to be a responsible and able driver.
H2: the instructor’s vehicle is equipped with a dash camera recording system for the safety of both the student and the instructor. The camera records the front, back and inside the car. Audio is also recorded. The recordings are intended for training, safety and insurance purposes.
- H2 a: Recordings captured by the dash camera are stored on the device’s internal storage. When the storage capacity is reached, the system automatically records over the oldest footage. While recordings are not deleted regularly, they are retained for as long as necessary to fulfil the purposes outlined above and in compliance with GDPR.
H3: Upon request, the instructor shall give the student a receipt for all sums received for lessons.
